What does "Ante '42" mean?

If you are reading a real estate listing or preparing the documents to sell your home, you have surely come across the term "Ante '42." But what does it mean exactly, and what consequences does it have on the real estate market?

The Watershed Date: August 17, 1942

1942 was not a date chosen at random. That year saw the enactment of Law no. 1150, known as the first true National Planning Law. Prior to this date, there was no generalized obligation in Italy to request a building permit to construct, unless the property was located within the inhabited centers of municipalities that had adopted their own specific regulations.

What is meant by an "Ante '42" property?

A property is defined as "Ante '42" when its construction was completed before August 17, 1942. For these buildings, the law provides a sort of "presumption of regularity": since a building title (such as a modern Building Concession or Permit) was not required at the time, the property is considered marketable even in the absence of original urban planning documents.

Why is it important for buyers and sellers?

1. Marketability of the asset To sell a property built after 1967 (the "Bridge Law"), it is mandatory to cite the details of the building permit in the notary deed. For properties built before 1967 but after 1942, proof of regularity is still required. For Ante '42 properties, the seller can replace these documents with a sworn statement (dichiarazione sostitutiva di atto notorio), declaring that construction began prior to August 17, 1942.

2. The issue of "Legitimate Status" A word of caution: "Ante '42" does not mean "absolute freedom." Today, with the Simplification Decree, proving the Legitimate Status of the property has become fundamental. If a property is Ante '42 but internal modifications, verandas, or expansions were made in the 1970s without authorization, those parts are not compliant and must be regularized before the sale.

3. Proof of dating It is not enough to simply say a house is old; you must prove it. In Sicily, where many historic centers consist of period properties, we use several tools:

  • Original cadastral maps (often dating back to 1939).

  • Vintage aerial photographs.

  • Analysis of construction materials and historical municipal maps.

  • Historical cadastral certificates.
