Dogs and Cats in Apartments: Knowing Your Rights for Happy Living in Catania

Living in a city center apartment doesn’t mean giving up the company of a four-legged friend. Yet, one of the questions we receive most often at Domus Sicilia during property viewings is: "Does the building allow pets?" Let’s clear this up once and for all, because the law is clear and peaceful coexistence is absolutely possible.

1. The Law is on Your Side: No Bans Allowed

Since 2013 (Condominium Reform), Article 1138 of the Italian Civil Code establishes a fundamental principle: condominium regulations cannot ban the ownership of pets. This means that:

  • No assembly can vote to evict your dog or cat.

  • Even if a regulation is "old" and contains a ban, that clause is null and void under current law.

  • Note: This applies to the building regulations (condominio), but in the case of a rental, the property owner can include a clause in the lease agreement that prohibits pets. It is always best to discuss this beforehand!

2. Common Areas: Freedom with Rules

Your dog has the right to use the elevator, stairs, and entrance hall, but as an owner, you have specific duties to maintain the building’s decorum:

  • Short Leash: In common areas (lobby, landings, courtyards), dogs must be kept on a leash (maximum length 1.50 meters).

  • Hygiene: It is mandatory to clean up immediately if the pet soils an area. It seems obvious, but it is the number one cause of neighbor disputes in Catania!

  • Muzzle: You don't have to put it on at all times, but you must carry it with you in case of necessity or if requested in crowded spaces (like a small elevator).

3. Noise and Smells: The Limit of "Normal Tolerance"

This is where coexistence comes into play. The Civil Code speaks of "normal tolerance."

  • Barking: A dog that barks occasionally (when the mailman rings or someone passes on the landing) is considered natural. A problem arises only if the barking is continuous and disturbing, especially during rest hours.

  • Odors: Cleaning balconies and cat litter boxes is fundamental. In a warm city like ours, neglect can become a nuisance for neighbors downstairs.

4. The Balcony: Safety and Privacy

In Catania, we love our flowered balconies. If you have a cat, consider installing transparent protective nets: they save the cat's life and do not alter the architectural decorum of the facade (a topic dear to prestigious buildings).
