Imagine having found the perfect buyer, agreed on the price, and being ready for the final signing (rogito). 1. What Are Civic Uses (Usi Civici)?

A civic use is a right belonging to a specific community (the inhabitants of a certain municipality or hamlet) to benefit from a piece of land: for grazing, sowing, or collecting firewood. Even if nobody comes to gather firewood in your backyard today, if that land originated as "civic domain" (demaniale civico), the restriction remains legally stamped on the property history.

2. Why Is It a Problem for a Sale?

By law, land burdened by civic uses is inalienable, cannot be acquired through adverse possession (inusucapibile), and is not subject to a statute of limitations (imprescrittibile).

  • Invalidation of the Deed: If you sell a house built on land with an active civic use without removing it first, the deed of sale is completely null and void.

  • Mortgage Freeze: Banks never grant financing for properties with this irregularity, as they consider them invalid collateral.

3. The Solution: Legitimation (Legittimazione) or Release (Affrancazione)

All is not lost. There are administrative procedures to "free" the property, but they require technical processing time and specific expertise.

  • Liquidation/Release (Liquidazione/Affrancazione): This involves paying a sum of money to the Municipality or the managing entity to extinguish the rights of the community. Once the indemnity is paid, the land becomes "allodial"—meaning it transitions into full and free private property.

  • Legitimation (Legittimazione): This is a more complex procedure applied when permanent structures (such as your house) have been built on the land and the soil has completely lost its original agricultural purpose.

4. How Do You Find Out If a Civic Use Exists?

It often does not appear on standard land registry searches (visure catastali). Definitive proof is obtained through:

  • The Urban Destination Certificate (Certificato di Destinazione Urbanistica or CDU) requested from the Municipality.

  • Checks with regional State Land Experts (Periti Demaniali).
